Woman cuts off husband’s penis, detained for 10 days and fined 200 yuan

The topic “Woman cuts off husband’s penis, detained for 10 days and fined 200 yuan” has triggered a huge debate on social media recently.
The Hubei PSB announced through a public platform that a woman named Yang had cut off her husband’s penis while they were at her brother’s home in Xiangyang City.
The police later put Yang under administrative detention for 10 days and fined her 200 yuan.
Many people have taken to social media to express their dissatisfaction with the punishment, as they think it is too light compared to the crime committed.
Since then, many experts on the field as well as the local police have given detailed explanations of the punishment.

Fujian, the director of Henan Zejin Law Firm, said that as far as intentional injury towards others is concerned, punishment would be light if it is a minor injury, but police will open a criminal case if the injury is serious.
In this case, since the report of the investigation for the seriousness of the injury has not yet been completed, the police can only make an administrative punishment on the accused first.
The law stipulates that if it is a minor injury, then the perpetrator will be detained for not less than 5 days but not more than 10 days and fined not less than 200 yuan but not more than 500 yuan.
When the investigation report is completed and it is determined that the injury is a serious case, then the police will treat it as a criminal case and Yang will be taken to court for sentencing.
The local police also responded that the current punishment is only the first step while they are waiting for the final injury report from the expert.
They will determine whether or not Yang should shoulder the legal responsibility when the report is completed.
